Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the services provided by Vox247, Inc. (“Vox247,” “we,” “our,” or “us”). By creating an account, subscribing to our services, interacting with any Vox247 AI voice agent, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.
1. Services
Vox247 provides a platform for creating and operating custom AI voice agents that people can interact with by calling an assigned phone number. Our Services include:
Assignment and hosting of phone numbers linked to AI voice agents.
Call recording, transcription, and AI voice generation.
Storage and processing of call data.
Account management and subscription-based access to features.
The Services may include features and content provided by third parties (see Section 11).
2. Eligibility and Accounts
Age: You must be at least 18 years old to purchase or subscribe to our Services. Individuals under 18 may experience the end products of the Services (e.g., interact with an AI voice agent) only with the consent and supervision of a parent or legal guardian who has purchased the Service.
Account Security: You are responsible for all activity under your account. You must maintain the confidentiality of your login credentials and notify us immediately of any unauthorized use.
Accuracy of Information: You must provide accurate, current, and complete information when creating an account or subscribing to our Services.
3. Subscriptions, Billing, and Payment
Auto-Renewal: All subscriptions are billed on a monthly auto-renewing basis until canceled.
Payment: You authorize us (through our payment processor, Stripe) to charge your chosen payment method each billing cycle.
No Refunds: All fees are non-refundable, including for partial months of service, unused features, or account inactivity.
Price Changes: We may change our subscription prices with at least 30 days’ prior notice before your next billing cycle.
4. Use of the Services
You agree to use the Services only in compliance with applicable laws and our Prohibited Use Policy (Section 9). You are solely responsible for all data, audio, and other content you provide (“Input”) and for your use of any AI-generated audio, text, or transcripts (“Output”).
5. Intellectual Property
Vox247 Ownership: Vox247 owns all rights, title, and interest in and to the Services, including all software, models, voice agents, and related technology.
AI Outputs: All Outputs generated by the Services are owned by Vox247. You are granted a limited, revocable, non-exclusive, non-transferable license to use Outputs for your lawful, internal purposes.
License to Inputs: By providing Inputs, you grant Vox247 a worldwide, irrevocable, perpetual, sublicensable, royalty-free license to use, store, reproduce, modify, distribute, and create derivative works from your Inputs for the purposes of delivering the Services, improving and training our AI models, and developing new features.
6. Call Recording and Transcription
When you or others interact with a Vox247 AI voice agent, the audio is recorded and transcribed. You agree to obtain all necessary consents from participants before enabling or using these recording features, as required by applicable law.
7. Privacy
Our Privacy Policy describes how we collect, use, and protect your personal data, including call recordings, transcripts, and contact information. By using the Services, you consent to the processing of your personal data in accordance with our Privacy Policy.
8. Third-Party Services
We use certain third-party service providers to operate the Services, including:
Eleven Labs Inc. – for AI voice generation and storage/processing of call recordings and transcripts.
Stripe – for payment processing.
Your use of these components of the Services may be subject to their respective terms and privacy policies.
9. Prohibited Use Policy
You may not use the Services to:
Violate any law, regulation, or third-party rights.
Generate, transmit, or store content that is unlawful, harmful, defamatory, harassing, hateful, discriminatory, obscene, or otherwise objectionable.
Impersonate another person or entity without consent.
Engage in fraud, deception, or malicious activity.
Interfere with, disrupt, or harm the operation of the Services or others’ use of the Services.
Use the Services to create or distribute synthetic voices of real individuals without their permission.
Violation of this policy may result in immediate suspension or termination of your account, legal action, and/or cooperation with law enforcement.
10. Termination
We may suspend or terminate your access to the Services at any time, for any reason, including for violation of these Terms or non-payment. You may cancel your subscription at any time, but no refunds will be issued.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Vox247 will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for all claims arising out of or relating to the Services will not exceed the greater of (a) $100 or (b) the amount you paid to Vox247 in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Vox247 and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Services, your Inputs, or your violation of these Terms.
14. Dispute Resolution and Arbitration
(a) Binding Arbitration – You and Vox247 agree to resolve any disputes arising out of or relating to these Terms or the Services through binding arbitration administered by JAMS under its rules.
(b) Class Action Waiver – You may bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
(c) Opt-Out – You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@vox247.com with your request.
15. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles. If a dispute is not subject to arbitration, it will be resolved exclusively in the state or federal courts located in Washington State, and you consent to the jurisdiction of those courts.
16. Export Controls
You may not use or export the Services in violation of U.S. export laws or regulations.
17. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law, such as by email or through the Services. Your continued use of the Services after the changes take effect constitutes acceptance of the new Terms.
